1. Acceptance and Definitions

These Terms of Use are legally binding for all natural and legal persons ("User") who visit, become a member, or receive services through the website www.brainviaspine.com and all related digital applications ("Platform").

By using the Platform, you declare that you have read, understood, and accepted all of these terms without any limitation.

2. Scope and Nature of Services

BrainViaSpine is a coordination platform focused on expert neurosurgery. Services offered include:

2.1. Neurosurgery Pre-Evaluation and Information

General information and process guidance based on expert physicians' opinions are provided for radiological images such as MRI, CT, X-ray, and epicrisis reports uploaded by the user. This content is advisory in nature, not a medical decision.

2.2. Specialist Physician and Hospital Matching

Options are presented regarding the most suitable accredited health institutions and specialist surgeons for the patient's clinical condition (herniated disc, brain tumor, scoliosis, Parkinson's, etc.); appointment and communication traffic is managed.

2.3. Health Tourism and Logistics Coordination

For international patients, pre- and post-treatment airport VIP transfer, hotel accommodation arrangements, and hospital admission processes are coordinated through contracted third-party providers.

2.4. Post-Treatment Follow-up

Services are provided for tracking the recovery process after surgical operations, data transfer to the patient's physician in their own country, and planning periodic check-up appointments.

3. Medical Disclaimer and Important Warnings

3.1. Diagnosis Authority: BrainViaSpine is not a hospital, medical center, or diagnostic organization. Our company is an authorized intermediary that bridges licensed health institutions and patients.

3.2. Final Decision: Medical diagnosis, treatment planning, and application decisions are made entirely by licensed surgeons and hospital boards where the patient is physically examined. Opinions on the Platform are in the nature of "second opinion" aimed at confirming or offering options to the patient's local doctor's decisions.

3.3. Emergency Responsibility: The Platform is not an intervention tool for emergency medical situations such as sudden brain hemorrhage, severe spinal cord trauma, or stroke symptoms. The user should immediately call the emergency service number (112, 911, etc.) in their country in such situations.

4. User Obligations and Prohibited Behaviors

4.1. Accurate Information Declaration: The User undertakes that all medical history, radiological images, and identity information uploaded to the Platform are accurate, up-to-date, and belong to them (or the person they are guardian of). The Company cannot be held responsible for medical or legal errors arising from false information.

4.2. Legal Compliance: The User may only use the Platform for legitimate purposes. They cannot make shares that violate other persons' medical privacy.

4.3. Technical Security: The User is responsible for protecting their own account passwords. Attacking the Platform, infecting it with malware (viruses, trojans, etc.), and stealing content through data scraping methods are strictly prohibited.

4.4. Privacy Violation: Unauthorized publication of messages with doctors or staff and shared reports in public areas is prohibited.

5. Fees and Payment Terms

5.1. Pricing: General information areas of the Platform are free. Expert physician opinion, detailed file review, and package health tourism services are paid. Fees are clearly communicated to the user before the transaction.

5.2. Payment Methods: Payments can be collected via credit card, bank transfer (EFT/Wire), or international secure payment systems (Stripe, PayPal, etc.).

5.3. Exchange Rate Differences: The user is responsible for the exchange rate and bank commissions at the time of payment in international payments.

6. Cancellation and Refund Policy

6.1. Consultancy Services: According to the Distance Contracts Regulation; within the scope of "services instantly performed electronically," the right of withdrawal cannot be used and no refund is made after an expert physician has started file review or a report has been created.

6.2. Operational Services: For cancellations made before hospital, hotel, or transfer reservations are finalized, the remaining amount is refunded after deducting the expenses made by the Company. After the reservation is finalized, the cancellation terms of the relevant institution (hotel, airline) apply.

7. Limitation of Liability

7.1. Surgical Results: The outcome of medical interventions and surgical procedures depends on variables such as human biology, patient's age, and lifestyle. BVS DOCTORS / BrainViaSpine does not guarantee 100% success for any treatment or surgery.

7.2. Third Party Errors: The relevant health institution is directly responsible for damages arising from medical care provided in the hospital environment, nursing services, or physician application errors (malpractice). The Company's responsibility is limited to organization and coordination defects.

7.3. Technical Interruptions: The Company cannot be held responsible for temporary problems in accessing the Platform due to infrastructure maintenance, internet outages, or cyber attacks.

8. Intellectual Property Rights

All original texts on the Platform, visuals and illustrations of brain and spinal anatomy, videos, logos, and software codes belong to BVS Doctors. Copying, uploading to other sites, or distributing this content for commercial purposes without the written approval of the Company constitutes a crime under Law No. 5846 on Intellectual and Artistic Works.

9. Privacy and Data Protection

Personal and medical data belonging to the user are processed in accordance with BrainViaSpine's "Privacy Policy" and "KVKK Information Text." Sensitive health data is shared only with relevant physicians and hospitals with consent.

10. Service Suspension and Termination

The Company reserves the right to suspend or permanently terminate the User account without prior notice in case of violation of these terms, sharing of fake identity/medical information, failure to fulfill payment obligations, or threatening platform security.

11. Dispute Resolution and Jurisdiction

These Terms of Use are subject to Turkish Law. In any dispute that may arise, good faith negotiation and mediation will be tried first. If a resolution cannot be reached, İzmir Courts and Execution Offices have exclusive jurisdiction.

12. Changes

The Company has the right to update these terms at any time in line with legal regulations or new service models. Current terms are valid for all users from the moment they are published on the Platform.
